Establishing the inquiry
Following determination that a public inquiry should be set up, the Minister will establish the inquiry.
This section considers the steps that the Minister must take to establish an inquiry. In particular he must:
- Draft the terms of reference. The terms of reference will be of enormous importance in ensuring that the inquiry will be able to assuage the public concern that has led to its establishment.
- Amend the terms of reference where appropriate.
- Select the Panel. In choosing the Inquiry Chairman, the Minister will choose a model for the public inquiry, in particular whether it is to be a judicial inquiry.
